Terms of Service

These Terms of Service ("Terms") govern your use of the Nailto platform operated by Nailto ("we", "us", "our"), accessible at nailto.eu. By using our service, you agree to these Terms.

1. Service Description

Nailto is an online booking platform for nail masters and beauty professionals. Masters create a personal booking page where their clients can book appointments. The service includes booking management, SMS notifications, Google Calendar sync, analytics, and payment processing.

2. Account Registration

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• One person or entity may not maintain more than one free account.
• You must be at least 16 years old to use our service.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Plans and Pricing

• Free plan: 1 booking per day, booking page, Google Calendar sync.
• Pro plan: Unlimited bookings, SMS confirmations and reminders, campaigns, analytics. Priced at 15€/month (monthly) or 12€/month (yearly, billed as 144€/year).
• Prices are in EUR and include applicable taxes.
• We reserve the right to change pricing with 30 days notice.

4. Payments and Billing

• Payments are processed securely by LHV Paytech (EveryPay), a licensed payment service provider regulated by the Estonian Financial Supervision Authority.
• Pro plans are billed in advance for the selected billing period (monthly or yearly).
• If your plan expires and is not renewed, your account will automatically revert to the Free plan.
• Refunds are handled on a case-by-case basis. Contact us within 14 days of purchase.

5. Promotional Codes

• Promotional codes provide temporary access to the Pro plan at no cost.
• Each account may use only one promotional code.
• Promotional codes cannot be combined, transferred, or exchanged for cash.
• We reserve the right to deactivate promotional codes at any time.
• Abuse of promotional codes (including creating multiple accounts) may result in account suspension.

6. SMS Services

• SMS reminders are sent to clients before their appointment (24h and 2h before).
• Pro plan includes 50 SMS reminders per billing period. Unused included SMS do not carry over.
• Additional SMS can be purchased and carry over to the next month.
• Additional SMS pricing: 0.17€ (1-30), 0.15€ (31-100), 0.13€ (101+) per SMS.
• SMS campaigns and cancellation SMS are charged separately from the included 50.
• SMS delivery depends on third-party carriers and is not guaranteed.
• You agree not to use our SMS service for spam, marketing without consent, or any unlawful purpose.

7. Client Data and Bookings

• As a master, you are responsible for the data you collect from your clients through Nailto.
• You agree to handle client data in accordance with applicable data protection laws (including GDPR).
• Client phone numbers and names are stored to facilitate booking management and SMS delivery.
• Clients can cancel their bookings through the confirmation page.

8. Google Calendar Integration

• Google Calendar integration is optional and requires your explicit consent via Google OAuth.
• We create and delete calendar events corresponding to your bookings.
• We do not access, read, or modify your existing calendar data.
• You can disconnect Google Calendar at any time from your dashboard.
• Our use of Google APIs complies with the Google API Services User Data Policy.

9. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Impersonate another person or entity
• Attempt to gain unauthorized access to our systems
• Send spam or unsolicited messages through our SMS service
• Interfere with or disrupt the service
• Scrape or harvest data from the platform
• Create multiple accounts to abuse free trials or promotional codes

10. Intellectual Property

The Nailto name, logo, and platform design are our intellectual property. You may not copy, modify, or distribute our branding without written permission. Content you create (service descriptions, business information) remains yours.

11. Limitation of Liability

Nailto is provided "as is" without warranties of any kind. We are not liable for:

• Lost bookings or missed appointments due to technical issues
• SMS delivery failures caused by third-party carriers
• Loss of revenue resulting from service downtime
• Actions taken by clients or third parties

Our total liability is limited to the amount you paid for the service in the preceding 12 months.

12. Termination

You may close your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be deleted within 30 days unless retention is required by law.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use of the service after changes constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the Republic of Estonia. Any disputes shall be resolved in the courts of Tallinn, Estonia.
